What is a personal injury claim?

Personal Injury is a very broad phrase used to describe a wide variety of situations which result in some type of bodily injury or death due to the negligence of another. Common examples of personal injury claims include automobile accidents, slip and falls, construction accidents, product liability claims and mass transportation accidents, such as airplane crash disasters.

What is negligence?
The law imposes upon each of us a duty to act with reasonable care, or to exercise the care of an ordinarily prudent person in the same situation. The failure to act with reasonable care is referred to as negligence. In order for a personal injury claim to be successful, it is necessary to establish that the injury is the result of another's negligent act or omission. You will not be able to recover damages for injuries you sustain in an accident where there is no related negligence.

What should I do if I am injured in an accident?
As in any situation in which you sustain injury, you should seek immediate medical attention for injuries you sustain in an accident. It is important to accurately convey to your physician or other health care provider the manner in which you were injured and the exact nature of all injuries you sustained in the accident. It is also a good idea to take some photographs of your injuries, if they can be observed, and of any physical evidence that pertains to the accident, such as damaged vehicles or visibly defective products. Keeping an accurate record of continuing accident-related health problems following the incident, such as headaches or other pain, will also be useful in pursuing your claim and may later serve as valuable evidence in your case.

Do I need an attorney if I am injured in an accident?
Yes. You should contact an attorney as soon as possible following an accident. Insurance companies representing the party whose negligence caused your injury will appear on the scene shortly following the occurrence of an accident. It is the job of the insurance representative to look out for the interest of their insured. You should, therefore, retain an attorney experienced in personal injury to protect your interest in the event you are injured in an accident. Under no circumstances should you speak with an insurance representative or negotiate a settlement of your claim until you have consulted with an attorney. In addition, your attorney will be able to preserve valuable evidence in your case by conducting a thorough investigation of the events surrounding your injury. A delay in seeking legal representation quickly may result in the loss or destruction of important evidence.

How much time do I have to pursue a personal injury claim?
Each state has what is referred to as a Statute of Limitations, or time period within which a personal injury claim must be brought. While the Statutes of Limitation vary from state to state, accident victims in Pennsylvania generally have two years from the occurrence of the accident in which to file a claim. Some claims require notification within a shorter time period, therefore, you should not delay.

How much will it cost to have an attorney review my case?
One of our attorneys will be happy to review your claim at no cost to you. If, following the initial consultation, a decision is made to pursue a claim in your behalf, fees will be assessed on a contingency basis. This means that your attorney will receive a percentage of the amount ultimately recovered in your case. Costs for things such as filing fees, medical records and accident investigation will be paid for in advance by our office, and we will receive reimbursement for those items at the time of recovery. If there is no recovery, you will not be charged a fee and you will not be responsible for the reimbursement of any costs advanced.
